What is probate?

Probate is the process of transferring ownership of an estate - the property, assets and possessions of a deceased person.

Unless the estate is very small and with no freehold or leasehold property (such as a house or flat) the personal representatives of the deceased will have to obtain a document (called a Grant of Representation) issued by the Court showing their entitlement to deal with the estate.

What if the deceased did not make a will?

If the deceased did not make a will and therefore died ‘intestate’, the next of kin will have to apply for a Grant of letters of administration. The Law will state how the Estate is to be distributed and if no relatives are found this will be paid to the Crown.
